1. Who we are and what these terms cover
These Terms of Service are an agreement between you and ArcXet Group, Inc., doing business as Mobile Mark Notary (“Mobile Mark,” “we,” “us”). They apply to your use of myflron.com, the notary and records request forms, and every service we provide: in-person notarial acts, remote online notarization, marriage solemnization, Florida county eRecording, court-record and Official Records retrieval, and certified copy pickup and delivery.
Mobile Mark Notary is a fictitious name (d/b/a) of ArcXet Group, Inc. and is not a separate legal entity. Every service is provided by ArcXet Group, Inc.
“You” means the person who sends a request or uses the website, and any company or firm that person represents. If you send a request for someone else, you confirm that you are authorized to do so and that you will give the signers and the requesting party a copy of these Terms.
Each request is also governed by our Service Agreement. These Terms are part of that agreement. If the two conflict, the Service Agreement and the written confirmation or invoice for your order control.
By using the website or sending a request, you agree to these Terms. If you do not agree, do not use the website or our services.
2. Notarial acts are official acts
Notarial acts are performed by a Florida notary public commissioned in the notary's own name under Chapter 117, Florida Statutes. The notary exercises independent judgment required by law. Neither you nor Mobile Mark can direct the notary to perform, complete, or refuse an act, and payment does not entitle anyone to a notarization.
The notary will decline or stop an act, without liability, when Florida law or reasonable judgment requires it, including when:
- A signer's identity cannot be established by personal knowledge or satisfactory evidence (§117.05(5), F.S.);
- A signer does not appear before the notary in person or by audio-video communication technology (§117.107(9), F.S.);
- A signer appears unable to understand the nature and effect of the document, or appears not to be acting freely (§117.107(5), F.S.);
- A signer does not speak or understand English and the nature and effect of the document has not been translated into a language the signer understands (§117.107(6), F.S.);
- The document is incomplete or contains blanks (§117.107(10), F.S.);
- The signer is the notary's spouse, son, daughter, mother, or father, or the notary has a financial interest in or is a party to the underlying transaction (§117.107(11)–(12), F.S.); or
- The notary believes the act would be unlawful, fraudulent, or improper.
A notarization confirms the identity of the signer and the fact of the signature, oath, or acknowledgment. It does not confirm that the contents of a document are true, lawful, valid, enforceable, or sufficient for any purpose.
You or the document's preparer choose the notarial certificate. The notary will not select a certificate for you, prepare or complete a document, or change a document after anyone has signed it (§117.107(7), F.S.). The notary may attest to a copy only as allowed by §117.05(12), F.S., and not for vital records or public records that are available from the official custodian.
3. Remote online notarization
Online notarizations are performed by a Florida online notary public physically located in Florida. Signers and witnesses may be located elsewhere (§117.209(3), F.S.). A signer located outside Florida confirms, verbally or in writing, that the signer wants the act performed by a Florida notary under Florida law (§117.265(3), F.S.).
Each signer must complete remote presentation of a government-issued identification credential, credential analysis, and identity proofing such as knowledge-based authentication. If any step cannot be completed, or the identity-proofing databases do not contain enough information about the signer, Florida law prohibits the online notarization (§117.265(4), F.S.). Fees in that case are handled under Cancellations and refunds.
The session is recorded in audio and video. The notary keeps an electronic journal, and the recording and journal are retained for at least ten years (§117.245, F.S.). By joining a session, each participant consents to that recording and retention. Copies of journal entries and recordings are available to the persons listed in §117.255, F.S., on the terms stated there.
The notary selects the online notarization platform (§117.265(5), F.S.). Signers must accept the platform's own terms to use it. Each signer is responsible for a working device, camera, microphone, and internet connection. We are not responsible for the security of systems used by signers (§117.295(5), F.S.) or for platform outages outside our control.
Witnesses to an online act must meet §117.285, F.S. A witness appearing remotely must be a U.S. resident located in the United States at the time of witnessing. For wills, certain trusts, health care advance directives, and powers of attorney with banking or investment powers, remote witnessing is not effective for a signer who is a vulnerable adult, and the platform's screening questions may require witnesses to be physically present with the signer.
Marriages cannot be solemnized by online notarization (§117.209(1), F.S.).
4. Records services
Records services are administrative. They are not legal services, notarial acts, title or closing services, or escrow services. We do not file in court cases or through the Florida Courts E-Filing Portal on your behalf.
eRecording. We submit customer-prepared instruments through a third-party eRecording platform to the Florida counties and document types that platform supports. The county recording office alone decides whether a document is accepted, how it is indexed, and when it is recorded. The public record kept by the county is the official record.
Electronic PDFs. A document submitted as an electronic PDF must be the file exactly as delivered by the notarization platform. We do not return the PDF. Evidence of recording, which may include the recorded image, instrument number, book and page, and county receipt, is emailed to the requesting party's email address stated on the request. That email is the delivery of our work product.
Paper originals. Paper originals are logged in when received and returned by the method chosen on the request. Originals not collected within 30 days after the order closes are returned by tracked mail to the address on file, and postage plus the $10 handling fee is billed to you.
Retrieval. We retrieve public records as made available by the custodian. We do not guarantee that a record exists, is complete, or is available on a particular date. Sealed, confidential, or access-restricted material is requested only with verified authority and the custodian's approval.
Rejections. If a county or clerk rejects a submission, we report the reason as stated by the office. If the rejection results solely from our submission error, we resubmit without another service fee. Any other correction is yours to make, and a corrected document is a new order.
Taxes. You provide the documentary stamp tax and intangible tax amounts. We do not calculate taxes or determine whether a tax is owed. You are responsible for any shortfall, interest, or penalty assessed on a document we submit at your direction.
Recording a document does not establish that it is valid or enforceable, and it does not create, perfect, renew, or preserve a lien or any other right.
5. Your responsibilities
You agree that:
- The information you give us is accurate and complete, including names, counties, page counts, indexing, and tax amounts;
- You have authority to request the service and to direct any recording or retrieval;
- Documents you give us are genuine, complete, and lawful, and are not being used to commit fraud or any unlawful act;
- Each signer will appear with acceptable identification, is to your knowledge willing and able to understand what they are signing, and is signing voluntarily;
- You will arrange any required witnesses unless we agree in writing to arrange them;
- You are responsible for confirming, before the service, that the receiving party will accept the document in the form it will be delivered, including online notarizations and electronically recorded documents; and
- You will get legal advice from a licensed Florida attorney on the content, form, execution, and legal effect of your documents.
6. Pricing, estimates, and payment
Current fees are posted on the pricing page. The estimate on a request form is an estimate. The Square invoice we send after reviewing your request controls.
Notarial fees do not exceed the Florida maximums: $10 per in-person notarial act (§117.05(2)(a), F.S.), $25 per online notarial act (§117.275, F.S.), and the amount allowed for solemnizing a marriage (§117.045, F.S.). Travel, the online platform and session fee, rush and after-hours charges, waiting time, and records service fees are charges for services other than notarial acts. They are stated separately and agreed to before service.
A rush fee applies automatically when the requested start is less than six hours after the request. An after-hours charge applies automatically to appointments outside Monday through Friday, 8:00 a.m. to 7:00 p.m. Eastern. Waiting time caused by signers, documents, or facility access is billed at $20 for each 15 minutes after the first 20 minutes past the scheduled start. Additional acts performed at an appointment are billed at posted rates.
Notary appointments are confirmed when the invoice is paid. Records work begins only after the service fee and estimated government charges are paid. Government charges are passed through at cost and reconciled when the order closes: any shortfall is billed before submission, and any overpayment is refunded to the original payment method.
Payment is processed by Square. We do not receive or store full card numbers.
If you believe a charge is wrong, contact us first. Disputing a charge for services that were performed or earned under these Terms is a breach of these Terms, and we may provide your request, invoice, and records of completed work to the card processor to respond to the dispute.
7. Cancellations, rescheduling, and refunds
- In-person appointments. Full refund if you cancel 48 hours or more before the appointment. Inside 48 hours, notarial fees are refunded and travel and scheduling charges are kept.
- Online sessions. Full refund if you cancel before the session is set up on the platform and at least six hours before the start. After that, the $15 platform fee is kept; fees for acts not performed are refunded.
- Records services. Full refund before retrieval or submission begins. After that, the service fee is kept. Government charges are refunded only to the extent they have not been paid and are refundable.
- Rush and after-hours charges are not refundable once travel or the session begins.
Appointments that cannot be completed. If, after the notary arrives or the online session opens, an act cannot be performed for a reason not caused by us, such as an absent signer, unacceptable identification, a signer who cannot communicate or understand, failed identity proofing, an incomplete document, or missing witnesses, the travel, platform and session, rush, after-hours, and waiting charges are earned. Notarial fees for acts not performed are refunded.
Rescheduling is treated as a cancellation and a new request unless we confirm the new time in writing without charge.
If we cancel or cannot attend, you receive a full refund of the amounts paid for that service. That refund is our only obligation for the cancellation.
8. Communications and electronic records
You agree that we may contact you and the signers by email, phone, and text message at the contact information on the request about scheduling, documents, invoices, and completion of the service. Message and data rates may apply. Tell us if you do not want text messages.
You agree to do business electronically. Your typed name on a request form is your electronic signature, and our electronic records of your request and acceptance have the same effect as signed paper records (§668.50, F.S.).
9. Privacy and records we keep
Our Privacy Policy explains how we collect and use personal information. We use the information and documents you provide only to perform, bill, and document the service, to meet legal and recordkeeping duties, and to protect our legal rights. We do not sell personal information.
Online notarization journals and recordings are retained for at least ten years as Florida law requires. Documents uploaded through this website are deleted 90 days after we receive them, and request records are deleted five years after we receive them, unless a legal hold applies. Uploaded documents are not sent by email. Records may be disclosed when required by subpoena, court order, or other lawful demand.
10. No legal advice
I am not an attorney licensed to practice law in the State of Florida, and I may not give legal advice or accept fees for legal advice.
No one at Mobile Mark will select a form, draft or complete a document, choose a notarial certificate, explain a document's legal effect, calculate taxes, or advise whether a document should be signed, recorded, or retrieved. Consult a licensed Florida attorney.
11. No other promises
We will perform the services with reasonable care as described in these Terms and the Service Agreement. We make no other warranty, express or implied. We do not guarantee that any lender, title company, court, county, clerk, government agency, foreign authority, or other receiving party will accept a notarized, recorded, or retrieved document, or that any office will process it by a particular date. The website and its content are provided as is.
12. Limitation of liability
To the fullest extent Florida law allows, our total liability arising from or related to any service or request, under any legal theory, is limited to the service fees you paid us for that service. Government charges, taxes, postage, and other pass-through amounts are not service fees.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost or delayed transactions, missed closing, filing, or recording deadlines, financing or rate-lock costs, or loss of lien or title priority.
These limits do not apply to damage caused by our gross negligence or willful misconduct, and they do not limit any liability that cannot be limited under Florida law, including the rights of a person harmed by a notary's breach of official duty under the notary's bond.
13. Indemnification
You agree to indemnify and hold harmless ArcXet Group, Inc. (including its Mobile Mark Notary trade name), its officers and employees, and the notary from claims, losses, and reasonable attorney's fees arising from the documents, information, or instructions you provide; misrepresentations by you or any signer; the conduct of signers, witnesses, or others you bring to an appointment; or your breach of these Terms. This does not apply to losses caused by our gross negligence or willful misconduct.
14. Events beyond our control
We are not responsible for delay or failure caused by events outside our reasonable control, including hurricanes and other severe weather, emergency declarations, road closures, facility lockdowns, courthouse or clerk closures, county or eRecording system outages, online notarization platform failures, and utility or internet failures. We will tell you promptly and reschedule, or refund amounts for services not yet begun.
15. Disputes, governing law, and venue
Before filing any claim other than a small claims action, the party with the complaint will give the other written notice and at least 30 days to resolve it.
Florida law governs these Terms and every service, without regard to conflict-of-law rules. Any lawsuit must be brought in the state courts located in Seminole County, Florida, and both parties consent to that venue.
Each party knowingly and voluntarily waives any right to a trial by jury in any lawsuit arising from or related to these Terms, the Service Agreement, or any service.
In any lawsuit arising from these Terms, the Service Agreement, or any service, the prevailing party is entitled to recover reasonable attorney's fees and costs, including on appeal.
16. Use of the website
The website is general information about our services and is not legal advice. Fees, county charges, and schedules can change; the invoice for your order controls. Links to other sites are for convenience, and we are not responsible for their content.
You may not submit false or fraudulent requests, use automated means to submit forms, upload malicious files, or interfere with the site. We may refuse or cancel any request.
The Mobile Mark Notary name, logo, mascot, and website content belong to ArcXet Group, Inc. and may not be used without written permission.
17. General terms
These Terms, the Service Agreement, and the written confirmation or invoice for your order are the entire agreement about the service. If any part is found unenforceable, the rest remains in effect and the unenforceable part is limited to the extent necessary. Our failure to enforce a term is not a waiver. You may not assign these Terms without our written consent.
We may update these Terms by posting a new version with a new effective date. The version in effect when you send a request applies to that request. Sections on payment, cancellations, records, liability, indemnification, and disputes survive completion of the service.
